Terms of Service

These are the terms you agree to when you make an account on this site or use the No Parking app. They cover what we owe you, what you owe us, and what happens if either of us wants to stop. We have tried to write them the way we write everything else here — plainly, and short enough that you might actually read them.

"We" and "No Parking" mean the gym at 800 Main Street, Ouray, Colorado, and the software it runs. "You" means whoever is signed in. If you don't agree with what's below, don't make an account — nothing here is compulsory, and the gym itself is a separate arrangement.

There is nothing to buy on this site right now. If that changes, the price will be on the page before you're asked for a card.

Cancel yourself

Any paid plan cancels from your own account, without emailing anyone and without being talked out of it.

Not coaching

What the app tells you about your training is a reading of numbers you logged. It is not medical advice, and it is not a coach watching you lift.

Paid memberships

Nothing is sold here yet
Every feature on this site is currently free, and dues for training in the space are arranged with the gym directly, not through this app. The rest of this section governs paid plans if and when they are offered.
Billing
Payments would be handled by Stripe. We never see or store your card number. You'd manage the card, the receipts, and the cancellation from a billing page of your own.
Renewal
A plan renews on its own at the end of each period — monthly or yearly — at the price you signed up at, until you cancel. We'll email you before a yearly plan renews.
Cancelling
Cancel whenever you like. Access runs to the end of the period you already paid for; it doesn't stop the moment you click, and it doesn't renew after that.
Refunds
A yearly plan is refunded in full if you ask within 14 days of paying. After that, and for monthly plans, we don't refund part-used periods — you keep the access you paid for instead. If something on our side broke and you paid for a month you couldn't use, write to us and we'll make it right.
Price changes
If a price goes up, we'll email you at least 30 days before it applies to you, and it never applies to a period you've already paid for. Cancelling before then costs nothing.

Your account

One account, one person. Give us a real name and a real email address — the schedule only works if the name on an hour is the person standing in it, and a password reset only works if the address is yours.

Accounts are for adults. If you're under 13 we can't make you one; younger athletes train under a parent or guardian's account. New accounts are approved by the gym's owner before they can book, which is a person reading a list, not a machine — it usually takes a day.

Your password is yours to keep safe. Anything done from your account is treated as done by you, so if you think someone else has it, change it — that signs out every device, everywhere, immediately.

Booking an hour

Open-gym hours are first come, first served, and each hour holds a fixed number of people. Book only the hours you intend to train, and cancel the ones you won't — a held spot nobody uses is a spot somebody else wanted. Repeatedly booking and not showing up is a reason we may take booking away.

Hours, capacity, closures and the booking window are set by the gym and can change, including at short notice for weather, maintenance or a holiday. Booking an hour is not a promise the gym will be open in it, though we'll tell you if it won't be.

Training in the space is a separate arrangement with the gym, with its own membership, dues and waiver. Nothing on this site replaces that, and an account here is not by itself permission to train.

Training, and what this app is not

Functional fitness is strenuous, and lifting heavy things carries real risk of injury. You train at your own risk, you decide what you're fit to attempt, and you are responsible for stopping when you should. Talk to a doctor before starting, especially if anything about your health makes that a sensible thing to do.

The programming published here, the prescribed loads worked out from your own maxes, and the written assessments of your training are information, not instruction and not supervision. They're generated from the results you logged, by software, and they can be wrong — a number typed in wrong, a workout logged on the wrong day, or simply too little data to say anything useful. Read them the way you'd read a training log, not the way you'd read a prescription.

Nothing in this app is medical advice. It doesn't diagnose anything, it isn't physical therapy, and it has no idea what your body is doing. If something hurts, that's a question for a doctor, not for a scoreboard.

What you put in

Your results, personal records and any workouts you build stay yours. You give us permission to store and display them for the purpose of running the app — which includes showing a result you post on that workout's scoreboard, where the other members who trained that day can see it. Personal records are yours alone and are never shown to anyone else.

Don't put anything into the app you wouldn't want on a whiteboard: no abuse, no impersonating anyone, no content that isn't yours to post. We can remove anything that breaks that, and tell you why.

The programming the gym publishes is ours. Read it, train it, keep your own copy of your own results — but don't republish the gym's programming as a product of your own.

Fair use of the software

Don't try to break in, don't scrape it, don't automate booking to corner the schedule, and don't use it to get at anyone else's information. This is a small site run on a small server; the ways to spoil it for everyone are not subtle.

When it's down

We'll keep the site up and the data safe as well as we're able, and we back it up continuously. We can't promise it will never be down, never lose a booking, or never send a reminder late. It is offered as it is. If an outage costs you a booked hour, tell us and we'll sort the hour out — that is the remedy we can actually give, and to the extent the law allows, it's the one we're offering.

Ending it

You can delete your account yourself, from your profile or in the app, at any time. It takes your bookings and your recorded results with it, straight away, and we email you a copy of your history on the way out. Nobody will try to talk you out of it.

We can close an account that abuses the site, the schedule, or other members. If we do it for a reason that isn't yours — we shut the service down, say — and you'd paid for a period you can no longer use, we refund that period.

Changes to these terms

If these terms change, this page changes first and the effective date at the top moves with it. If the change is a significant one — anything about money, or anything that takes something away — we'll email members rather than quietly updating the page, and you'll have the chance to leave before it applies.

Which law

These terms are governed by the laws of the State of Colorado, and any dispute belongs in the state or federal courts serving Ouray County, Colorado. If a court decides some part of this page can't be enforced, the rest of it still stands.
